Terms and Conditions

1. Acceptance of Terms

By registering, accessing, or using the Nostalgic Emulation service ("the Service"), you ("User") agree to be bound by these Terms and Conditions ("Terms"). If you do not accept these Terms, you may not use the Service.

2. Description of Service

Nostalgic Emulation is a digital entertainment platform that allows you to:

• Play classic video games directly in your browser through emulation
• Store and restore game saves in the cloud
• Participate in online multiplayer sessions (netplay)
• Access a library of classic game titles

The Service is offered under three plans:

• Free: Basic access with limited storage, at no cost.
• Plus: Expanded storage and additional features. Monthly subscription.
• Pro: Maximum storage and full access to all features. Monthly subscription.

3. Subscription and Billing

3.1 Billing cycle. Plus and Pro plans are billed monthly at the price in effect at the time of purchase. The monthly period begins on the activation date.

3.2 Automatic renewal. Subscriptions renew automatically at the end of each monthly period. The charge will be processed through MercadoPago on the same date each month. By confirming your subscription, you expressly authorize this recurring charge.

3.3 Taxes. Prices shown include taxes applicable under current Chilean law. Users residing in other jurisdictions are responsible for compliance with their own local tax obligations.

3.4 Payment processor. Payments are processed through MercadoPago. By making a payment, you also accept MercadoPago's Terms and Conditions. Nostalgic Emulation does not store credit card or payment instrument data.

4. Price and Terms Changes

We reserve the right to modify prices and these Terms. Any changes will be communicated to Users with at least 30 days' notice via the registered email address or a prominent notice on the platform. If you do not accept the changes, you may cancel your subscription before the effective date of the new terms at no additional cost.

5. Cancellation

5.1 You may cancel your subscription at any time from the Billing section of your account.

5.2 Cancellation takes effect at the end of the current monthly period; plan benefits remain active until that date and no further charges will be made.

5.3 No proportional refunds are issued for unused time in the current billing period, except as described in Section 6.

6. Right of Withdrawal and Refund Policy

6.1 Right of withdrawal (Chile). In accordance with Article 3 bis of Chilean Consumer Protection Act No. 19,496, Users have the right to withdraw from the contract within 10 business days of the subscription date, provided they have not made effective use of the Service during that period.

6.2 Waiver of withdrawal right. If you access the features of your subscribed plan before the 10-business-day period expires, you expressly consent to the immediate commencement of the Service and acknowledge that, having used the Service, you forfeit the right of withdrawal as provided in Article 3 bis of Act No. 19,496. This waiver is recorded when you check the acceptance checkbox during the subscription process.

6.3 Refund for service failure. If the Service experiences a total outage attributable to the provider lasting more than 72 consecutive hours within a billing period, you may request a proportional refund for the days of inactivity.

6.4 How to request. To exercise your withdrawal right or request a refund, contact [email protected] with your username and reason. We will respond within 5 business days.

6.5 Users in other jurisdictions. Users residing outside Chile may have additional withdrawal or refund rights under their local consumer protection laws. Nostalgic Emulation will honor such rights where they are applicable and duly established.

7. Acceptable Use and Intellectual Property

7.1 Nostalgic Emulation is a classic video game emulation service oriented toward personal use and digital preservation. The platform provides emulation infrastructure and storage technology; it does not offer commercial software distribution services.

7.2 You represent that you use the Service exclusively for personal, non-commercial purposes.

7.3 Video game content may be protected by intellectual property rights held by their respective owners. You are solely responsible for complying with the intellectual property laws applicable in your jurisdiction.

7.4 The following are expressly prohibited:

• Sharing access credentials with third parties
• Using the Service for commercial purposes or mass distribution
• Attempting to access other Users' accounts or circumvent system security
• Automating access to the Service via bots or scripts without authorization
• Any activity that interferes with the operation of the Service or its infrastructure

8. User Accounts

8.1 You are responsible for maintaining the confidentiality of your credentials and for all activities conducted through your account.

8.2 You must immediately report any unauthorized access to your account to [email protected].

8.3 We reserve the right to suspend or terminate accounts that violate these Terms, with prior notice except in cases of serious violations or fraudulent activity.

9. Service Availability

9.1 The Service is provided "as-is." We do not guarantee uninterrupted or error-free availability.

9.2 The Service may experience interruptions due to maintenance, updates, or technical circumstances. We will communicate scheduled maintenance in advance where reasonably possible.

9.3 As the Service operates on personal infrastructure, no specific service levels (SLA) are guaranteed.

10. Privacy and Data Protection

10.1 Upon registration, you provide your email address, which is used exclusively for account management and Service-related communications.

10.2 The Service stores the following User data:

• Email address and password (bcrypt-encrypted)
• Game session history (title and duration)
• Cloud save files
• Active subscription plan and renewal date

10.3 No personal data is shared with third parties, except as strictly necessary for payment processing through MercadoPago.

10.4 You may request deletion of your account and all associated data at any time by writing to [email protected].

11. Limitation of Liability

To the maximum extent permitted by applicable law, the provider's total liability for any claim related to the Service shall not exceed the total amount paid by the User in the 12 months preceding the claim. The provider shall not be liable for indirect, incidental, special, or consequential damages.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Chile, in particular Consumer Protection Act No. 19,496 and its amendments (including Act No. 21,398). Any dispute arising from these Terms shall be subject to the jurisdiction of the ordinary courts of Chile. Notwithstanding the foregoing, Users residing in other jurisdictions retain the rights afforded by their local laws, including access to their applicable consumer protection authorities.
